Conference Terms & Conditions for The Liner Hotel

1 Who is this contract between?
The contract is between The Liner Hotel Conference Department and you, not any other person or organisation for which You book rooms, meals or facilities. You accept responsibility for paying all charges, including any extra charges arising under this contract. The contract is personal to you and you may not transfer your rights under this contract to any other person, or organisation.

2 Provisional bookings
The Liner Hotel Conference Department may agree to you making a provisional booking of which, the date will be agreed accordingly. You may cancel provisional bookings without penalty. If you do not confirm your provisional booking within the agreed date, we reserve the right to cancel, but will endeavour to give you 48 hours notice.

3 Confirming your booking
Your booking becomes confirmed, on the basis of these terms and conditions, upon receipt by The Liner Hotel Conference Department of an unaltered Event Schedule signed by you. The Event Schedule will state the accommodation, meals and other facilities which you have booked, and it will include a clear statement of any other arrangements which have been agreed between You and The Liner Hotel Conference Department. If you verbally ask The Liner Hotel Conference Department to confirm a booking, you must send The Liner Hotel a signed Event Schedule. The Liner Hotel Conferences must receive this within 5 days of your verbal request or it may, at its sole discretion, cancel the booking. When you confirm a booking, you agree to pay all the charges for accommodation, meals and other facilities set out on the Event Schedule, unless these are changed or cancelled under the terms of clauses 6, 7, 8 or 10 below. In that case you must pay the charges in accordance with the relevant clause.

4 Making a booking more than a year ahead
If you book more than a year ahead, The Liner Hotel reserves its right to
increase its charges. When you book, you agree to pay the charges for the accommodation, meals and other facilities set out on the Event Schedule, plus VAT (if this applies) at the rate applicable at the time of the event. The Liner Hotel Conference Department reserve the right to increase its charges from the figures it quotes to you when you make the booking. However, The Liner Hotel Conference Department will not increase its charges in the 12 months before the event, following your confirmed booking, The Liner Hotel Conference Department will notify you of any changes to its charges. You will have the right to cancel the booking without charge provided that you notify The Liner Hotel Conference Department in writing within 2 weeks of The Liner Hotel Conference Department notifying you of the changes. If you do not withdraw from the booking then you agree to pay the increased amount.

6 Payment in advance
The Liner Hotel Conference Department reserves the right at any time to undertake a credit check to make sure that you will be able to meet all charges when they fall due. If The Liner Hotel Conference Department is not reasonably satisfied at any time that you will be able to meet the charges, The Liner Hotel Conference Department may, at its sole discretion, cancel the booking unless you pay a deposit or pay part or all of the charges in advance as The Liner Hotel Conference Department may decide. The extent of the deposit, or part payment, is at the sole discretion of The Liner Hotel Conference Department. The same applies if The Liner Hotel Conference Department later becomes aware of problems with your financial situation.

7 Overseas customers and guarantees
If you are a customer from outside the UK, The Liner Hotel Conference Department reserves the right to ask for a guarantee of payment from a UK Clearing Bank and to cancel the booking if the guarantee is not provided within 30 days of The Liner Hotel Conference Department request. You will have the right to withdraw your booking without charge within seven days of The Liner Hotel Conference Department telling you of its requirements, if they are not acceptable to you, by notifying The Liner Hotel Conference Department in writing.

8 Altering your booking
If, by written agreement with The Liner Hotel Conference Department, you alter your booking, The Liner Hotel Conference Department will send you a new Event Schedule to sign and return within 14 days, so that you know what you have booked and for what you are responsible. The Event Schedule will set out the accommodation, meals and other facilities which you have booked and agreed with The Liner Hotel Conference Department. It will include details of any extra facilities which you may have agreed with The Liner Hotel Conference Department and of any items you have cancelled but must pay for under clause 10. Each new Event Schedule issued by The Liner Hotel Conference Department will, when signed by you, replace any previous Event Schedule.

9 Extra accommodation, meals or other facilities
If you ask for any extra accommodation, meals or other facilities, The Liner Hotel Conference Department will use all reasonable endeavours to provide them. We cannot guarantee that we will be able to meet your requests but will make every effort to do so. We shall have no liability whatsoever should we fail to do so. Due to the nature of your individual event, there may be occasion to agree deadline time/s for the ordering of catering requirements and/or any other reason. The deadline dates for final orders will be agreed as part of the Terms and Conditions.

10 Cancelling all or part of your booking
In the event of cancellation more than 28 days prior to the event will not result in any charges the Liner Hotel Conference Department will not charge you for the cancellation.
25% of the total due will be charged for cancellations received within 28 days of the arrival date.
50% of the total due will be charged for cancellations received within 14 days of the arrival date.
100% of the total due will be charged for cancellations within 7 days of the
arrival date.

11 Giving us the final details
You must confirm in writing final timings, menus and any special food requirements not less than 7 days before the scheduled commencement of the event. If you do not do this, The Liner Hotel Conference Department will decide what it should supply and charge accordingly.

12 Changes or cancellations by us because of events beyond our control
The Liner Hotel Conference Department has the right to alter or cancel any booking that it cannot keep for reasons beyond its control. If this happens, The Liner Hotel Conference Department will use all reasonable efforts to offer you an alternative booking. The Liner Hotel Conference Department does not accept any liability or responsibility if it cannot provide accommodation, food, drinks or services because of industrial action or any other cause which is beyond its control.

13 Changes to room allocations
To meet the needs of as many clients as possible, The Liner Hotel Conference Department may alter the meeting rooms, dining rooms or residential accommodation allocated to you. There will be no extra charge to you if The Liner Hotel Conference Department change your room allocations.

14 Arrival and departure times
Accommodation allocation will be available from 2pm on the day of arrival. Check out of your accommodation on the day of departure is 11.00am. If you require your accommodation longer on your final day, there is a day let charge of £50.00. If you have any special requests for accommodation, please advise us at the time of reserving your event. Please note that special requests cannot be guaranteed.

15 Animals and pets
We regret we do not accept any pets or animals in The Liner Hotel of any kind, except guide dogs for the blind.

16 Food and drink
The Liner Hotel Conference Department calculates its charges on the basis that it will provide all food and drinks that you and your party need. You, or any member of your party, must not bring food or drinks onto Hotel premises to eat or drink here without the prior express agreement of The Liner Hotel Conference Department. You will be charged corkage or equivalent charges by prior arrangement and approval of The Liner Hotel Conference Department for all drinks or food brought in and consumed on Hotel premises.

17 Behaviour on our premises
You must make sure that you, members of your party and anyone visiting you at the Hotel behave in such a way that they do not cause a nuisance or unreasonable disruption to the Hotel, its guests or employees, or to any other visitor to the Hotel. You agree that you and the members of your party will comply with the Hotel rules and regulations.

18 Using the Hotel’s name without permission
You may not use:
• the name and/or logo of the The Liner Hotel and/or any of its departments or subsidiaries including the name and/or logo of The Liner Hotel.
• any photographs of any part of the Hotel without written permission from The Liner Hotel Conference Department and, in any event, only for the purposes of promoting the event.

19 Liability
The Liner Hotel Conference Department shall not be liable to you in contract tort (including without limitation negligence) and/or breach of statutory duty for any loss or damage which you may suffer by reason of any act, omission, neglect or default (including negligence) in the performance of this contract by the The Liner Hotel Conference Department, its servants or agents. The Liner Hotel Conference Department shall not be liable to you in contract tort (including without limitation negligence) and/or breach of statutory duty for any loss of profits and/or any indirect or consequential (including economic) loss of any kind which you may suffer by reason of any act, omission, neglect or default (including negligence) in the performance of this contract by The Liner Hotel Conference Department, its servants or agents.
Provided that nothing in these terms and conditions shall operate as:
• to exclude The Liner Hotel Conference Department non-excludable liability in respect of death or personal injury caused by the negligence of The Liner Hotel Conference Department, its servants or agents;
• to affect your statutory rights where you are dealing as a consumer within the meaning of the Unfair Contract Terms Act; or
• to exclude the application of Section 12 of the Sale of Goods Act 1979; or
• to exclude liability for fraudulent misrepresentation. 24 General
The provisions of these terms and conditions are severable and distinct from one another, and, if at any time any provision is or becomes invalid, illegal or unenforceable, the validity, legality or enforceability of the other provisions shall not in any way be affected or impaired.
The rights and remedies of The Liner Hotel Conference Department in respect of this contract shall not be diminished, waived or extinguished by the granting of any indulgence, forbearance or extension of time by The Liner Hotel Conference Department to you nor by any failure of or delay by The Liner Hotel Conference Department in ascertaining or exercising any such rights or remedies. Any release, waiver or compromise or any other arrangement of any kind (a release) by The Liner Hotel Conference Department shall not affect its rights and remedies as regards any other party nor its rights and remedies against you in whose favour it is granted or made except to the extent of the express terms of the release and no such release shall have effect unless granted or made in writing. The rights and remedies in this contract are cumulative and not exclusive of any rights and/or remedies provided by law. These terms and conditions and the contract shall not constitute and shall not be deemed to constitute any relationship of partnership agency between The Liner Hotel Conference Department and you and shall not in any way create a lease of the Hotel premises. You shall not impede in any way The Liner Hotel Conference Department (or their agents and servants) in the exercise of the Hotel’s right of possession and control of each and every part of the Hotel premises. All notices under this contract shall be in writing and may be served by post or facsimile transmission addressed to the other party at the address given in this Contract or at such other address as a party shall from time to time by notice in writing give to the other party for the purpose of service of notices under this contract and every such notice shall be deemed to have been served. If served by post at the expiration of 3 days after despatch of the same or if sent by facsimile transmission at ten hours local time on the next normal business day of the recipient following despatch and in proving service it shall be sufficient to show in the case of a letter that the same was duly addressed prepaid and posted in the manner provided and in the case of a facsimile transmission report that it was transmitted to the correct telephone number. Saturdays, Sundays and Bank Holidays shall not in any event be treated as days on which service is effected, and service shall be deemed to take place on the next normal business day of the recipient.
For the avoidance of doubt nothing in these Conditions shall confer on any third party any benefit or the right to enforce any provision of these Conditions.
